A follow-up on recent events concerning the Griekwastad-murders

I have received several requests from readers to compile another article concerning this tragedy, especially now that the police have finally arrested a suspect in this matter.

I was intending on publishing a follow-up article only after the suspect had appeared in court and after he had pleaded in the matter, but it seems that this may take ages, so – in the interim, here is another posting on this tragedy:

The suspect, a 16-year old male juvenile and a relative of the Steenkamp family, made his first appearance in court today, in Griekwastad. The presiding magistrate apparently did not waste any time warning the media not to publish anything that may identify the youngster, although one doesn’t have to be a genius to figure out who he is.

For purposes of this posting (and possible future ones) I will thus do my very best to stick to the term “suspect”.

Incidentally, during the court proceedings today it came to light that the minor child’s lawyer was informed by the police on 23 May 2012 already that his client was officially a suspect in the murders.

According to various news reports the police decided to arrest the suspect after forensic evidence confirmed the presence of gunshot-residue on the suspect’s clothing and also the fact that his fingerprints were found on the two firearms. I cannot believe that this is all they have on the suspect. If this is true, then I’m afraid the State has no case whatsoever!

In court today:
@16:20 - The defence closed their arguments related to the bail application of the suspect. (The State is opposing bail on the grounds that there are three murders involved.)

The State also lashed out at the social worker testifying for the defence in the bail application of the 16-year-old suspect. The State prosecutor, JJ Cloete, accused the social worker of treating the suspect as a victim. Evidence, however, indicated he is a killer, the State said. - Source

@16:35 – Court adjourned until tomorrow. The investigating officer will then testify.


Various aspects of this tragic story have already been covered quite extensively in several postings on this blog, so forgive me for not repeating what has already been said. For the record the direct links to the previous postings are listed below, from the oldest to the latest:

A notable feature of Rapport’s recent headlines in the print edition of their newspaper – dated Sunday, 5 August 2012, is that Don’s name appeared in huge bold print without mentioning his surname. I’m merely mentioning this to point out how easy it was for the Naspers group of newspapers to condition the minds of their gullible readers by simply using two trigger code-words, namely: “Griekwastad” and “Don”. Click here to view a scanned image of Rapport’s front page. Bear in mind that this was printed at a time when the London 2012 Olympics was in full swing.

At this point in time it is perhaps worth mentioning an earlier Volksblad report, by Vicus Bürger - dated 11 May 2012. The report quotes one of South Africa’s top forensic pathologists, Dr. Leon Wagner, as saying: “I hope at heart that the Griekwastad-murders do not become another Inge Lotz sage.” - (Afr:” Ek hoop van harte die Griekwastad-moorde is nie ’n tweede Inge Lotz-sage nie.”)

I’m afraid Dr. Wagner may have hit it on the nail, especially in the light of recent reports related to the scanty evidence, as we all know by now that the two firearms in question were physically handled by the sole surviving member of the family, AFTER the shooting took place! The clothing of the sole survivor could thus easily have become contaminated with gunshot-residue AFTER the shooting - not only while the firearms were being handled, but also while there was contact with any other objects that were also contaminated with gunshot-residue. Don’t forget that there was at least seven (7) or more shots fired on the scene!

The following is provided for readers who are not too familiar with the Griekwastad tragedy:
Since the time that three cold-blooded murders occurred on a farm Naauwhoek in the Northern Cape near the town of Griekwastad, the name Don Steenkamp, sole survivor of the tragedy, has become a household name, with a negative connotation (thanks to the media), among the Afrikaans-speaking Christian community of South Africa.

The triple-murders took place on Good Friday, 6 April 2012. Two of the victims, Don’s father Deon Steenkamp (44), and Don’s mother, Christelle (43) were shot execution-style in the back of their heads. The third victim Marthella (14), Don’s sister, apparently tried to flee the horror-scene when the shooting started. According to a detailed Volksblad report, dated 16 April 2012, Marthella was shot outside the house, and her body was dragged back into the house while she was still alive. She was apparently shot twice, once in the side of her body and once in the head. The bodies of the other victims also showed evidence of multiple gunshot wounds, identifiable with gunshot wounds caused by .357Magnum and .22-calibre ammunition. Two firearms of similar calibre were picked up on the scene by Don Steenkamp and handed to the local police in Griekwastad.


Volksblad reporter, Hilda Fourie, mentioned in a report dated 26 May 2012 (3 months ago), that forensic and ballistic tests were finalized - (Griekwastad-moorde se toetse afgehandel). The reporter apparently got her information from a reliable source, but nowhere is there definite official confirmation of this, and neither is there any official statement by the police that the two firearms found on the scene were definitely linked to the murders.

My own attempts at trying to get confirmation of the official ballistic test-results, directly from the Forensic Lab in the Western Cape, ended up with me getting rather annoyed with their unwillingness to divulge the information.

There are many questions that arise from this apparent delay of getting the forensic test-results to the investigating officer. Why did it take almost three months for these results to be submitted to the police?  Were the results perhaps first sent to another 'undisclosed' department for scrutiny, or were they simply withheld to work on our nerves, and in the process also boost the sales of Naspers newspapers? – Just wondering!

Besides the above, I have another 100-and-10 questions racing through my mind. I suppose at the end of the day when this whole tragic affair has been finalised in court, the question of private gun ownership will once again raise it's ugly head in South Africa.

Let’s see what transpires in court tomorrow, and what nonsense will be splashed on the pages of this coming Sunday's Rapport newspaper.

I have just received some feedback from a high-ranking police official, who prefers to remain anonymous, that info published in the media concerning gunshot-residue and fingerprints on the firearms was quoted completely out of context. In other words, there is far more evidence involved. A tremendous amount of time and analysis has gone into the investigation of this case. There’s a good reason why the investigating officer has not revealed everything to the media.

Although the court is still busy with prosedures related to bail-application and the suspect has not pleaded yet, it appears at this point in time that the State’s case is wholly and fully watertight. The State is convinced that there is sufficient evidence to prove that the suspect committed 3x cold-blooded murders. While the investigating officer Dirk de Waal testified as a State witness in opposing the bail application, it emerged that evidence of blood splatter and scratch marks on the suspect will form part of the crucial evidence, i.e.… when the State starts presenting its case. The matter (bail application) has been postponed to Monday, 3 September 2012. The suspect will remain in State custody at the Galeshewe police station in Kimberley.

I believe the suspect turned 16 last week. Could that be the reason why the police waited until this week to arrest him, in other words, will he be treated differently by the court or will the proceedings be different if the suspect is a 16 year old in stead of 15 years old?

@ Lidia – No I don’t think his age had anything to do with why it took so long to arrest him. Age is a factor that determines the length of imprisonment the suspect must undergo once the court has found him guilty. The court will take into account the age of the suspect at the time of the commission of the offence, and not his age at the time of arrest.

How the court is going to deal with the sentencing of a 15-year old juvenile, who committed 3 heinous murders, is anyone’s guess. Thanks for your interesting blog Tia. I find it rather interesting that both Don & Fred, suspects of such high profile cases was students of Grey College....and also with all respect late Hansie Cronje who made such an moral judgement error ( at a lack of better wording) ....don't know the school, just an interesting fact that I observed during my interest in human behaviors

Baie dankie Tia vir die geleentheid om aan jou blog deel te neem. Jou kommentare is oor die algemeen objektief en insiggewend oor hoe die regsprosesse werk.
Dit wil voorkom asof die werklike motief vir die moorde nog nie in die media veel aandag gekry het nie. Kort na die moorde gepleeg is, was daar berigte dat jaloesie 'n moontlike motief kon wees. Hierdie afgelope week het 'n berig in die pers opgeduik dat die verdagte moontlik 'n aangenome kind van sy ouers was.
Die beweegrede vir sulke afgryslike moorde moes baie sterk gewees het om deur 'n 15jarige gepleeg te word.
Wat is jou opinie hieroor?

As expected the print version of the Afrikaans Sunday newspaper Rapport has again splashed this story on their front page, but this time with an extra bit of scandalous news. (They’ve kept the story out of their free online version to boost sales.)

Today’s bold headlines read: “Seks-kinkel onthul – Moord in Griekwastad” The paper is now implying that Marthella Steenkamp (14) was sexually molested by the accused, and that her father found out about it moments before they were all murdered. The paper alleges that they received confirmation of this from several sources close to the family. Rapport is thus implying that this could possibly be a motive for the murders.
Apart from placing emphasis on the fact that Marthella was beaten over the head with a blunt object after she fled the scene, the rest of the report is basically a repeat of what has already been published online by their many sister newspapers, the most prominent being Volksblad.

There is also a supplementary report by Hanlie Retief on page 13 with the headlines: “Mens wil nie weet nie”. It’s a lengthy report that covers the entire page. I’m going to read it now, and if there’s anything worthwhile mentioning I’ll report it here.

To the two anonymous commentators above – thanks for input! Yes, it is quite interesting to note that both Fred van der Vyver and also the suspect in this case were pupils of Grey College.

To the 2nd Anon commentator:
I’m not sure if the suspect is an adopted child, but I suppose it is a strong possibility. I will look into this and if I find anything I will report it here.

What I also found interesting was an announcement, dated 7 May 2012, on the Website of Grey College (see link below) about a guest speaker who visited the school to talk about Social Networks and their implications. The guest speaker, Johan de Beer, is a Functional Psychologist and the founder of Auksano (Trauma Therapy Centre). He is also a former Captain in the SAPS and the Coordinator of the Occult related crime units (SAPS) in the Free State.

Ek het per ongeluk op jou blog afgekom Tia. Baie dankie vir die info. Ek het net twee goed wat my pla. Behalwe soos jy sê die ballistiese toetse wat verkeerd kan wees na die wapens hanteer is.
Volgens wat ek so vinnig in die info kon opspoor was daar nog bloedbevlekte hempe gevind, behalwe dit wat Don aangehad het? Is dit waar of het ek misverstaan?
Die ander ding. As mens so kyk na waar die liggame gevind is, en volgens wat jy verneem is die moeder eerste geskiet... Hoe vinnig moes die verdagte gewees het om haar te skiet, die pa in die skouer te wond en dan die doodskote te gee? Dit moet darem taktiek vat. En ek kan ook nie sien dat enige ouer net sal stilsit as hy sy kind met 'n vuurwapen sien aankom nie. Of is ek nou verkeerd? Ek dink net hier is baie aan die saak wat nog glad nie sin maak nie.

Reline, die storie van die T-hemde het in Rapport verskyn. Neem ook kennis dat die jeugdige se naam nie genoem mag word nie.

Ek haal aan:
“Die beskuldigde het verder glo ná die voorval van twee hemde probeer ontslae raak. De Waal het in die hof getuig ’n donkerblou T-hemp is die dag ná die moorde in die beskuldigde se slaapkamer gevind. Dít nadat hulle die vorige dag op ’n ander hemp wat aan hom behoort het en wat hy elders weggegooi het, beslag gelê het. Die donkerblou T-hemp is glo op twee plekke geskeur en was oortrek met bloedspatsels.” - Volledige artikel hier.

Onthou, in die forensiese-veld is daar verskillende tipes bloedspatsels, soos ek reeds genoem het in vorige artikels (Deel 2 en Deel 3. Deel 2 praat van ‘n spesiale tipe ‘hoëspoed-spatsel’ (Engels: backspatter or blowback) wat op ander voorwerpe soos die wapen of selfs op kledingstukke van die skutter kan beland indien die skoot baie naby gevuur was. So, die getuienis-waarde van bloedspatsels op T-hemde hang af van die tipe spatsels en ook wie se bloed dit was.

Die ongelooflike 'skietkuns' van die beskuldigde (een persoon) is ook een van die 100-en-10 dinge wat my pla, maar nou-ja dit is tog seker maar moontlik dat hy sy slagoffers onverhoeds betrap het. Maar dan moes hy dit haarfyn beplan het, en ook baie vinnig opgetree het.

Ek wil net graag besoekers herinner dat die beskuldigde in die saak nog nie gepleit het nie, en dat die hof nog besig is met borgaansoek. Die borgaansoek word Maandag, 3 September voortgesit.

Hoe skiet die beskuldigde die vrou en die man verroer geensins vanuit sy stoel voor die TV waar hy dan 2de geskiet is nie ??? Hoe baklei so groot man soos Deon, nie teen 'n skrander seun van 15, die oomblik toe hy die 1ste en 2de skote hoor nie ??? Allegations of sexual molestation and rape are false!

Volksblad today published an article explaining how the rumours, which were published as headline news last Sunday in Rapport, came about. During the post-mortem a bruise was noticed near Marthella Steenkamp's private parts, but apparently the bruise holds no connection with sexual molestation or rape. The bruise is attributed to regular horse riding or a possible scuffle (moontlike worsteling). Full Volksblad report here.

SUSPECT OUT ON BAIL - Magistrate Oswald Mazwi said after considering all relevant evidence placed before the court, it would be in the interest of justice for the child to be released on bail. He said the child was not a flight risk, was receiving schooling and would not interfere with witnesses. He said it appeared that the child would not be a threat to any other person.

No date was set for the next court appearance. Preliminary reports indicate that the case will continue in the Kimberly High Court during the last two weeks of December this year.

@Tia Mysoa Twee vrae wat my pla: 1.In een van die heel eerste berigte oor die moord is die beskuldigde gevra oor die krapmerke aan sy nek. Sy antwoord was dat Marthella gesukkel het om asem te haal toe hy haar vasgehou het, en hom toe gekrap het, en dat sy ook met hom gepraat het. Hoe is dit moontlik na 4 skote, waarvan 2 kopskote was en haar kop ook verder verbrysel is?
2.Hoe kan die verdediging steeds, na alles wat in die hof uitgekom het, daarby volhou dat die staat geen direkte bewyse teen die beskuldigde het nie?

Vraag 1 - Ek is maar bra skepties oor al die ouer berigte wat in die koerante verskyn het, maar vir wat dit werd is -- kopskote hoof nie noodwendig altyd onmiddelik fataal te wees nie.

Vraag 2 - Die verdediging is 100% korrek. Daar is twee tipes getuienis: Direkte getuienis en omstandigheidsgetuienis. Op die stadium is daar geen direkte bewyse dat die beskuldigde die moorde gepleeg het nie… m.a.w. getuienis van ‘n ooggetuie, of selfs ‘n bekentenis van die beskuldigde nie. Forensiese bewyse is nie direkte getuienis nie - dit val onder die kategorie van omstandigheidsgetuienis. In hierdie geval sal al die forensiese bewyse gesamentlik, asook die getuienislewering van deskundiges wat daarmee gepaard gaan, dien as bevestigende getuienis.

Jammer ek reageer nou eers, maar ek sal eerder verkies om nie my persoonlike gevoelens oor die skuld of onskuld van die verdagte te openbaar nie. Ek het in elk geval nie al die feite tot my beskikking nie, en ook geen idee wat presies al die omstandigheidsgetuienis in die saak behels nie….Ek wens ek het insae gehad! Persoonlik dink ek dit gaan ‘n baie moeilike saak wees om te bewys in die hof, en as die verdagte nie ‘n bekentenis maak nie gaan die saak nog lank sloer.

Wat wel uitstaan in hierdie saak is die feit dat die verdediging met die borgaansoek hoegenaamd nie die meriete hanteer het nie. Daar is geensins die beskuldigde se voorgenome verweer aan die hof openbaar nie.

Dit sê vir my net een ding en dit is dat die verdediging wag en kyk met wat die staat vorendag kom.

Die verdediging het eerder die risiko gevat om geensins die beskuldigde se verweer te openbaar nie as om seker te maak hy kry borg: Dit sê net vir my dat die regsverteenwoordigers bang was om enige iets op rekord te plaas wat later deur die staat met forensiese getuienins weerlê kan word.

Wat betref die skuld of die onskuld van die beskuldigde, is my gevoel dat hierdie beskuldigde nooit gaan getuig nie.

Die beskuldigde kan sy swygreg uitoefen en slegs die swakpunte in die staat se saak aanval. Die beskuldigde het geen plig om die staat by te staan om sy saak te bewys nie en kan eenvoudig wanneer hy sy weergawe moet gee slegs verkies om stil te bly.

Ek stem honderd persent met Tia saam deur na net twee scenarios te kyk:

Al is daar kruid op hemde gevind en vingerafdrukke op vuurwapens,dit sê nogsteeds nie hy het die skietwerk gedoen nie. Indien daar enige ander moontlike afleiding kan wees moet die hof die beskuldigde onskuldig bevind.

Sy vroeëre weergawes van dat hy in die stoor was en die wapens opgetel het gaan niks tel nie, dis nie erkennings of bekentenisse nie en die hof gaan dit nie in aanmerking neem nie.

So vêr ek aflei is daar ook geen waarskuwingsverklaring afgelê nie en het die beskuldigde reeds daar sy stilswye gehandhaaf.

Die verdediging kan kom en twintig verskillende scenarios stel oor hoe die misdrywe gepleeg kon word en slegs stel dat die beskuldigde dit nie gepleeg het nie.

Geen saak is deesdae meer 'n gegewe in ons reg vir 'n skuldig of onskuldigbevinding nie.

Verstaan ek die wet reg... Met ander woorde,'n persoon of persone kan in iemand se huis instap,almal doodskiet en daarmee wegkom omdat niemand hom/haar/hulle gesien het nie. Dit nadat die verdagte/verdagtes se vingerafdrukke op die moordwapens,daar krapmerke afkomstig van een van die oorledenes aan sy/hulle/haar lyf is, en dat daar boonop geskeurde en bebloede HEMDE met die oorledenes se bloed gevind is wat aan die verdagte/verdagtes behoort. Die 20 miljoen wat beskikbaar gaan wees. Die geld in die kluis wat nie gesteel is nie. Die feit dat moordenaar/s eers die kluis gaan oopsluit het terwyl hy/hulle verby almal gestap het waar die gesin voor die tv en rekenaar gesit het. Die snaakse optrede na die moorde soos om toevallig eers na die werkers se huise te ry en dan sommer terloops die moordwapens op te tel. Die verdagte het verander van 'n ongelukkige,stil introvert tot 'n selfversekerde,gelukkige ekstrovert. Ek vermoed wanneer al die bewyse,getuienisse en verklarings aangebied en aangehoor is,die prentjie nog donkerder sal lyk. Soms is dit makliker om jou gesonde verstand te gebruik om die antwoord uit te werk as om die presiese wetlike proses te volg. Ongelukkig werk dit in die praktyk nie so nie......

Baie dankie vir die skakel na die boekwinkel. Ek het die artikel baie interessant gevind. Dit is vir my nou so helder soos daglig wat die verdagte se moontlike motief vir die moorde was – dws indien hy WEL skuldig bevind word. Daar is drie (3) tipe profiele uiteengesit. Die verdagte in dié saak pas die 2de profiel soos ‘n handskoen, veral as in ag geneem word wat alreeds in die media gesê was. Ek dink Grey het ook die regte besluit geneem.

So terloops ek het probeer om Volksblad se lesers na jou artikel te verwys, maar Volksblad weier om my kommentaar te publiseer. Dit wys jou maar net weereens wat se tipe boelies die naspers spul is!

I have believed from day 1 that this child committed the murder. He is obviously a very evil and clever murderer. I believe he planned it over and over in his head. Who knows, days weeks or months ahead of the time. He moved swiftly, he shot the mother in the back of her head. He moved then quickly to the lounge area where the dad was. The father obviously jumped up on hearing the shot and was immediately confronted by his son holding the gun, he then shot the father. Leaving the sister for last, she had time to run and was a bit more difficult to get under control. He did eventually manage to silence her as well. I beleive he applied the extra shots, after they were already dead.... to make sure they were dead. But he moved quickly and put them down, then shot them again to make sure. What does puzzle me though is.... how can Bennie Heckroodt, his guardian, protect him. My word... he is a monster, how can you not see he is as guilty as sin. How can he take pity on this child... does he feel nothing for the parents and his poor sister that must of died in a horrific way, realising that their very own child and brother was murdering them?... What does the guardian hope to get out of this? and how can any lawyer, want to protect this child?. Even for money!. The dead are crying out from their graves for justice while they are running around trying to find a way to get this evil child free, and organizing competitions for him to participate in.... Now that makes no sense to me!.

Ek stem volmondig saam met Anonymous se kommentaar. Moontlik is dit die rede waarom die beskuldigde se voog hom graag wil terughê by sy skool en in die koshuis. Hy het dalk aanvanklik nie besef dat hy waarskynlik aan 'n baie bose jong seun huisvesting gegee het nie. Volgens wat ek verstaan, is hy nie familie van die seun nie. Wow, mense vra hoe kan jy met n vuurwapen verby jou ouers stap en hulle doen niks nie, onthou dit is n plaas en daar word baie geskiet, teikens, wild en is dit nie iets ongewoon as jou seun die kluis oop sluit en n vuurwapen uithaal nie. Dalk gevra-se hy gaan bietjie met die wapen/s buite skiet en n ja antwoord gekry met wees net versigtig.Dit is hoe maklik n kind/seun op n plaas n wapen kan kry en is hy verseker vertroud met die wapens wat in die kluis is, het immers by sy pa die opleiding gekry en so is die pa ook tevrede om sy kind alleen met wapens te laat want hy ken mos sy seun en sy vaardighede.
Niemand het hom gehelp nie, hy jag koedoes alleen en skiet gereeld alleen, so hy is ook n goeie skut en weet presies hoe om watse wapen te gebruik waar en wanneer.

If this child gets away with these murders, my LAST drop of faith in the Justice Ministry of this country will be gone down the drain!!. I am dying to hear, how he explains away the torn, and bloodied T shirt found in his room, beside the T shirt he left at the police station. His poor sister put up a brave fight, tearing his T shirt in 2 places, and scratching his neck. He says she scratched his neck as she was dying to get breath?, that after been shot and hammered in the head? NO, she clearly put up a brave fight. He had the most time for his mother, but not enough to not kill her....his needs were bigger. He preferred to shoot her in the back of the head rather than face her, BUT, for the father and sister he had no compassion what so ever. Disgusting... riding his sisters horse 2 weeks after looking into her frightened eyes, and hearing her pleading voice.... he is very ill!!. Just cannot understand how Bennie Heckroodt and his lawyer can turn a blind eye to what he has very obviously done.

As I’ve already mentioned, the case has been postponed to 1 October 2012. Magistrate Oswald Mazwi released the suspect on R5000 bail and into the custody of his guardian, Bennie Heckroodt. However, soon after the child’s release his guardian was shocked to hear that the governing body of Grey College (Secondary) had made a decision not to allow the child back into the school’s boarding house while he was awaiting trial. The school was however prepared to supply the child with educational material to help him keep up to date with his school work. But despite this decision the child’s guardian, Heckroodt, was not too happy with the whole affair and summarily filed papers in the High Court claiming that the child’s constitutional rights, to receive tuition in a public school, were being infringed. According to Volksblad Heckroodt’s application will be heard in the Kimberley High Court on 27 September 2012.

In the meantime…
The State has filed an application for leave to appeal against the bail granted to the child. State prosecutor JJ Cloete contends that the magistrate erred in his finding that the boy was not dangerous to those around him. The appeal hearing would be heard in the High Court on the same date as Heckroodt’s application (27 Sept)… See report in News24 (English) or in Volksblad (Afrikaans).

My guess is Heckroodt’s application will not succeed, and that he will probably be admonished by the court for accepting responsibility as guardian of the child, while simultaneously opposing the decision of Grey College, which in my opinion was a correct decision to make under the circumstances. Heckroodt has a tough choice to make, and I find it rather odd that no other family members of this child (or any members of the local Church) are prepared to accept the role of guardianship. It is unacceptable to assume that the child’s boarding school must take responsibility of guardianship, especially when the seriousness of the charges is taken into account.

Let’s see what happens on 27 September and 1 October.

Tia Heckroodt se aansoek teen Grey in die Hoogeregshof in Bloemfontein hierdie Donderdag en nie die 27 ste in Kimberley nie. Dit is vreemd dat die kind se kamp so veg om hom terug te kry in die skool. Ek dink hulle besef dat indien dit nie gou gebeur nie hulle geen saak gaan he tydens die staat se appel teen borg die 27 nie of 'n baie swaker argument oor hoekom hy nie in aanhouding moet wees nie. Ek steun grey 100%. Darem baie onredelik om nie hulle besluit te aanvaar nie. Buitengewone omstandighede. My kind 'n groot vriend en kamermaat van die beskuldigde. Sorry ek meen koshuismaat en nie kamermaat. Dink hulle was net 3 plus homself in een kamer. Netnou dink iemand een van sy 3 maats se ouers die comment geskryf. Voel regtig baie jammer vir sy regtige "close" maatjies. Hulle glo natuurlik in sy onskuld. Ook maar net kinders van 15 en of 16. Hulle gedagtes en emosies word seker elke dag gepeper metwat alles in die koerante geskryf word oor hulle beste maat. So sad dat die tragedie so baie mense negatief raak. Gelukkig heel kinders se wonde gouer as ons grootmense. Dink net hoe familie en sy grootouers dit alles moet hanteer. I see the guardian of this boy has stated a number of times that he has a lot of support from friends, family and even strangers!. However, from my observation, articles I have read on the internet in the paper, I would say 98% of people that are aware of this case and following it are hoping for a successfull conviction of this teenager?. What judge Mazwi was thinking when he granted him bail is a mystery....then again not such a big mystery, rather an explanation as to why the country is also in the state it is in. I hope the next court appearance will show some intelligence from the judicial side.

UPDATE: Regarding the issue of tuition
OFM News reported today that an ‘out of court’ settlement has been reached between the minor child’s lawyer, Stoffel de Jager, and the school. The new agreement stipulates that the child will receive home schooling and that the school will deliver all the necessary tuition material. The child will remain a pupil of the school and may also have access to teachers in the event that he needs assistance with his school work.

According to De Jager the new agreement differs from what was negotiated beforehand with the school, but declined to provide further particulars.

Daar is al 'n paar keer berig dat die polisie 'n sterk saak teen die beskuldigde het. Ondermeer die forensiese getuienis, en dan word daar blykbaar sterk geleun op die feit dat die beskuldigde vir die polisie gelieg het. Dit word nie gemeld waaroor hy gelieg het nie.
Alhoewel die beskuldigde sy swygreg kan gebruik om homself moontlik te bevoordeel, sal dit hom nie van 'n skuldigbevinding red indien daar oorweldigende getuienis teen hom is nie.
Sy voog en regsmense se optredes laat my dink dat hulle tot elke prys nie 'n suggestie wil laat posvat dat hulle enigsins dink dat hy die moordenaar is nie.

The trial of the 16-year-old boy facing three counts of murder has been postponed today and will commence next year on Monday, 11 March 2013.

The State was ready to begin with the trial in November 2012, but the child’s legal representative is apparently not available then. As stated in an earlier update, the State has filed an application for leave to appeal against the bail granted to the child. State prosecutor JJ Cloete contended that the magistrate erred in his finding that the boy was not dangerous to those around him. The bail-appeal hearing will now be heard in the Northern-Cape High Court on 4 October 2012.

It will be interesting to see if the State’s bail-appeal will succeed, or not (I doubt it)… If it does succeed it means the child will have to be detained, at taxpayer’s expense, until his trial starts next year in March.

Tia, why do you doubt it will succeed?. I sincerely hope you are wrong about that. He needs to be detained till the end of his trial. The fact that he was granted bail was absolutely ridiculous. I have read a recent article in the You magazine, their interview was clearly with the boys guardian.... after reading the article, there is no doubt in my mind that the guardian is in denial. The boys legal representative also knows he is guilty, but probably hopes by defending the boy that it will be giving him as a professional some exposure.... sort of advertising. Yuk!!.

I doubt whether the State’s bail-appeal will succeed because we’re dealing here with a juvenile offender who has no previous convictions and who has, since the murders were committed, conducted himself ‘pleasantly’ – in other words, given no reason whatsoever that he is a danger to himself or to others. The new Child Justice Act also stipulates that a child has the right not to be detained except as a measure of last resort.

I see from the latest news reports on Volksblad, the state has said there were a mere 20 mins from the time the murders were committed to when the suspect arrived at the police station. This has been deduced by the fact that the suspects mother sent a sms to her sister 20mins before the suspect arrived at the station. So if he says he waited in the shed till the gun shots died down... someone went in murdered this family, got off the property, he went from the shed to the house, cradled his dying sister, got in the bakkie rode to warn the workers, then stopped to pick up the guns then proceeded to the station......what a long 20 minutes!. if he ran out immediately on hearing the is strange he saw no one... especially as his sister managed to run out the house was shot in the yard between the house and barn, taken back inside and shot again in the head... all without him seeing anyone.... he sure has got some explaining to do. Thank the Lord for the sms that was sent to the mothers sister, this I beleive has helped nail the criminal.

Ai! Dat die 20 minute nou so 'n bohaai oor gemaak word. Ek is seker die ondersoek beampte het sy werk deuglik gedoen alhoewel ek weet dat dit verseker nie 20 minute geneem het nie. Vorige Anoniem, jy kan reg wees met jou vertolking van die 20 minute, maar ek is seker die staatsaanklaer sou die inligting nie in die hof genoem het, as hy nie seker was van die tyd toe die SMS GESTUUR is nie.
In my vorige kommentaar het ek melding gemaak daarvan dat die beskuldigde vir die polisie gelieg het. Dit lyk nou asof dit oor hierdie tydsduur (tussen die tyd dat hy die skote gehoor het en sy optrede daarna, volgens sy verklaring) gaan waaroor die staat 'n sterk saak het.
Om te verseker dat hierdie saak in die hof aangehoor word, behoort die staat se apel vir sy aanhouding te slaag. Daar is te veel op die spel om die risiko te loop dat hierdie saak nie uitgepluis kan word nie. Die beskuldigde behoort in veilige bewaring gehou te word, sodat hy nie die regsproses kan verydel nie.

Look... I grew up with Don. I knew him and I walked a path with him.I went to school with him and often he used to bully me and actually he had caused harm to me. He was the cause of me having four cracks in my left arm. In my opinion he was a bully and that he deserves to be punished if found guilty. Him and his family weren't the ideal family. There was a lot of fighting between him and his father and he was constantly competing with his sister. Is it possible maybe for him to have been involved in some sort of satanic cult ,this is the word among lots of people in Douglas and Griekwastad that knew him and his family??

Dear Anon. You should make sure that the Police receive this information. I believe they have already discovered that he was not in harmony with his family at all, but you never know, your information could just confirm further that he is very capable of harm. It was so easy for him to do ,I dont know how people can doubt or think he could not do it on his own. After he shot his mother, he headed for his dad.... which father would think, "he" had just shot the mother dead, before the dad could realise what had happened he shot the father, his beautiful sister being last had a little time to run.... poor little thing, people who still have any sympathy for him should realise, she did not just "die" imagine her horror, her shock, her begging pleading... he can be glad we dont live in the old days, we would of marched over to his guardians house, hung him up and burnt down his guardians house. The sooner his gaurdian comes out of denial the better! Lock him up.

Nee wat daar is nie veel nuus nie! Die staat het mos verlof gekry om te appelleer teen die borgtog at toegestaan is aan die tiener, maar ’n datum vir die aanhoor van die appèl moet nog bepaal word. Verskeie berigte het op 4 Oktober al te kenne gegee dit volgende week sal gebeur, maar “volgende week” is al lankal verby, en daar is geen nuwe berigte nie (nie waarvan ek weet nie). Miskien is hulle vandag besig daarmee – dan sal ons vanmiddag laat miskien mediaberigte lees.

What does this mean in English?
It means that the judge heard both sides of the argument, but decided not to announce his decision immediately. In other words, judgement was reserved for a later time (date unknown) until the arguments of both sides had been thoroughly reviewed… In the meantime the suspect remains in the care of his guardian, Bennie Heckroodt.

Ek het gister die klagstaat gesien op die posklip forum. Groot dele daarvan was uitgeblok – seker maar waar die verdagte se naam genoem word. Die klagstaat openbaar ook niks nuuts nie. Court dismisses Griekwastad appeal

Bloemfontein - The appeal against the bail of a 16-year-old boy accused of the Griekwastad family farm murders was dismissed in the Northern Cape High Court on Wednesday.

The State appealed against the R5 000 bail granted to the boy in the Griekwastad Magistrate's Court earlier.

The boy was arrested for the murders of Northern Cape farmer Deon Steenkamp, aged 44, his wife Christelle, aged 43, and their daughter Marthella, aged 14, who were shot dead on the family farm Naauwhoek on 6 April.

The trial was expected to start in March next year.

Appealing the magistrate's bail judgment, the National Prosecuting Authority contended that the magistrate erred in finding the boy was not a danger to those around him.

The State argued the magistrate over-emphasised the boy being a child.

Case still to be proved

Delivering judgment, Kimberley High Court judges Cecile Williams and Pule Tlaletsi held the only factor the State advanced on the boy being a danger to society was the degree of violence towards others implicit in charges against him.

However, the State's case has still to be proved at trial.

Other relevant factors to be considered were that he was not a flight risk, was in no position to interfere with witnesses, and it could not be reasonably inferred that he was a danger to the public or would commit other offences.

The judges found the boy had led an exemplary life in the past and that proper schooling could not be guaranteed at a youth centre.

He was now also in a stable environment with a guardian where he received the necessary guidance and discipline before trial.

The judges also found that the argument by the boy's counsel that being a child could be seen as an exceptional circumstance on its own was wrong.

The court held children had been shown to commit the most heinous crimes, to be repeat offenders, and to be a danger to society.

"The respondent [boy] being a child is an important factor, which should be taken into account together with all the other relevant factors in determining whether special circumstances exist," the judgment reads.

@Estelle – The claim about the horse was made by a commentator on one of Rapport’s online articles (link here). The claim is that he shot the horse 3 weeks before the murders took place. Whether the claim is true or not is another matter.

Dié skokkende wending toe die gewysigde klagstaat vandeesweek by die Noord-Kaapse hooggeregshof ingedien is, kom ná maande se bespiegeling nadat dit vroeër aan die lig gekom het dat daar ’n kneusing aan Marthella se geslagsdeel was.

Destyds is dit afgemaak dat dit van perdry of van ’n worsteling voor haar dood was.

Nou sê die staat dat die seun op 6 April op die plaas Naauwhoek wederregtelik en opsetlik die minderjarige Marthella teen haar wil gepenetreer het.

Die oppervlakkige skaafwond op Marthella se geslagsdeel dui op ’n handeling van gedwonge seksuele penetrasie, waarskynlik binne 24 uur voordat sy vermoor is.

Die staat beweer die tienerseun het Marthella verkrag.

’n Verdere aanklag van regsverydeling is ook nou by die drie aanklagte van moord op die klagstaat gevoeg.

Die seun word van die moorde op Marthella, haar pa, Deon, en ma, Christel, op hul familieplaas Naauwhoek aangekla.

Marthella was ’n skrander leerling aan die Hoër Meisieskool Oranje in Bloemfontein.

Na verneem word, sal die gewysigde klagstaat amptelik op 11 Maart by die hof ingedien word.

Luidens dié klagstaat het die lys van staatsgetuies ook intussen van 76 tot 91 gegroei.

Die verdediging het vandeesweek ook glo van die jongste verwikkelinge kennis geneem.

Intussen het die seun se regspan en hul deskundiges die plaas besoek om hulle te vergewis van die geboue en waar dit op die werf geleë is.

Hulle beplan om hul eie misdaadontleders en ’n deskundige in forensiese en anatomiese patologie, prof. Izak Loftus, as getuies te roep.

Die seun is op 21 Augustus verlede jaar in hegtenis geneem, waarna hy op borgtog van R5 000 vrygelaat is.

Die staat se appèl teen die borgtog het misluk. Die verhoor is van 11 Maart vir drie weke op die hofrol geplaas.

I will be posting an article soon about the current court proceedings. The proceedings are moving extremely slow… I thus cannot see how the State is going to finalize the case in a matter of 2 - 3 weeks, not if their number of witnesses has grown from 76 to 91 – according to the new charge sheet that was submitted when the trial started on Monday.

It is interesting to note from the latest news reports that the Primary Residue Test was done on the boy. It was initially unclear whether this test was performed on the suspect, or not. As mentioned in an earlier posting (Part 3) it is standard procedure to perform this test a soon as possible on all suspects, including deceased persons. The real value of the Primer Residue test is that it can associate an individual with a firearm. However, it cannot identify a specific person as the definite shooter, because a person can pick up the residue simply by handling a dirty weapon or discharged ammunition components.

This is an excellent site, thank you. I am interested in the forensic evidence of the fingerprint on the glass: Tia, is it possible for forensics to determine WHEN the fingerprint was left there - i.e. what day and what time?

@ Claire Rossiter – thanks for visiting and for leaving a comment (and a compliment). There is unfortunately no reliable method of determining the age of the fingerprint. A few modern-day techniques are experimenting with this, but there are so many variables involved with age detection that none are considered scientifically trustworthy at this point in time.

It's the first time I really paid attention to the griekwastad drama. Looking into the "happy" eyes of that kid! Anyone can see what he did, and how he did it. His sister finally had a way to tell her mom. He listened in fear when his sister was talking to their parents about his actions, he felt sad and betrayed. Anger took over, then he rushed to get the gun. On his way to the living room area, he saw his dad first and he shot him. His terified sister rushed to her moms arms where he turned the gun on her yelling at her she is liar. He shot her and he looked at his mother for a moment and then he shot her too. Natural instinct kicked in and he is still bussy planning his way out of this.. It's just a matter of time before he breaks into peaces. If I was his pshycologist or friend he would've hanged himself already.
